Set Up Your Legal Structure

So far you’ve done much of the work to establish the foundation of your business. But, before you go too far you need to make sure your business is established properly and protected. This is a very important step in starting your new business. Starting a business is not the same as starting a hobby. You must dot your “I’s”, cross your “T’s”, and stay on your “P’s and Q’s.”

If you skip over this step or do not take it seriously it can really come back to haunt you later. Not setting up the appropriate structure your business can bankrupt you personally and open you up to all manner of litigation and sanctions.

  • Decide your business legal structure (see the section on legal and tax considerations)

  • Register your business name with the appropriate agencies

  • Get trademark protection for your business name, logo, and other service marks, especially if you intend to use it for products and services

  • Get applicable licenses and permits from federal, state, and local agencies

  • Get a domain name 

  • Get an EIN (employer identification number) from the IRS

  • Find a registered agent

  • Find a small business attorney to advise you
